Welcome to Soulfy!
 
This Terms of Agreement (“Agreement”) governs the relationship between users (“You”) and Soulfy Technology Limited (“Soulfy,” “We,” or “Us”) regarding your use of our website located at soulfy.app (the “Website”), our mobile apps for Android and iOS devices (each an “App”), and any other services provided (collectively, the “Services”).
 
By accessing or using the Services, you agree to comply with this Agreement. If you do not wish to accept this Agreement, you may not access or use the Services. Your use of certain features within the Services may also require you to agree to additional terms before being granted access.
 
We reserve the right to modify this Agreement at any time, and your continued use of the Services after changes are implemented means you accept those changes. Please check this page regularly for any updates. If you do not agree to the modifications, you must stop accessing or using the Services.
 
We strive to cultivate genuine human connections and conversations. While AI technology continues advancing, as a community we feel the close bonds that form are best experienced between people. Should any automated or synthetic accounts be discovered, they will be removed from participation. This helps ensure everyone interacting on the platform is a real person. We don’t intend this as a stance against AI, simply a necessity for the type of engaged human experience we aim to provide.
 
The Services are meant to foster connections between users in a respectful community environment. Users must treat others with courtesy, respect and kindness when interacting through Soulfy. Any behaviour that threatens, harasses or bullies other users will not be permitted. 
 
Eligibility
 
To participate as a member of the Soulfy community, certain minimum age requirements must be met. Specifically, you must be at least 18 years of age, or have reached the age of adulthood as defined by the laws of your local area, whichever is greater. By registering for an account and utilising the platform, you are acknowledging that you meet this age of consent standard. To report age violations, please send an email to [email protected].
 
Use of service
 
In order to use Soulfy, users are required to set up an Account. This involves providing and verifying your email address. Some additional services, such as financial transactions, may involve further identity verification steps for safety and compliance reasons. To register for monetary functions, we may need to validate your identity by requesting identification documents. Additionally, having a linked Paypal account enables financial interactions within the App.
 
It is important that Soulfy Accounts are used responsibly and as intended. Your Account is for your individual access alone, to engage authentically with the community according to social and financial features. Authorising others or selling/transferring ownership of your Account would not be permitted. Soulfy is not liable should an unauthorised third party access your log-in information. You are solely responsible for keeping your credentials private. If any issues arise related to improper access of your Account by others due to sharing or theft of login details, it is essential you notify [email protected] immediately.
 
Please note that certain jurisdictions may have specific laws or restrictions regarding the acceptable use of the Soulfy platform. As an individual accessing or engaging with the service from outside of Hong Kong, you assume full responsibility for understanding and abiding by the legal and regulatory framework that governs digital activities within your own territory or region. It is expected that all members use Soulfy in a manner that is compliant with local rules and guidelines, wherever in the world they may access the community from.
 
As a user, you are solely responsible for any content that you provide, including things like profile details, messages, audio recordings, photos or videos.This means that if any content you submit or make available raises legal issues or concerns for others in the community, you accept liability for your individual actions. Soulfy cannot be held responsible for any problems that stem from content generated directly by users themselves.
 
For safety and privacy reasons, certain types of personally identifying information should not be publicly visible on user profiles within the Soulfy community. Specifically, members agree to refrain from posting private contact details like phone numbers or email addresses directly within their written profile text.
 
General prohibitions
 
You agree not to use the Services for any purpose that is illegal, or prohibited by these Terms, and to comply with all applicable laws and regulations when using the Services. Specifically, you agree not to 1. Engage in, promote, or encourage prohibited or illegal activities. 2. Post, upload, publish, submit or transmit any content that: (i) Infringes upon another party’s intellectual property, privacy or publicity rights; (ii) Is defamatory, obscene, pornographic, vulgar or offensive; (iii) Promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; (iv) Is artificially inflated, falsified or undisclosed advertising; (v) Harasses, stalks or threatens another individual; or (vi) Collects or stores personal data about other users. 3. Use bots, internet robots, scrapers or other automated means to access the Services in a manner that sends more request messages to our servers than is reasonably necessary to use the Services. 4. Attempt to circumvent any content filtering techniques we employ, interfere with any aspect of the Services, or send spam or other unwanted communications. To report these violations, please email us at [email protected]. Soulfy may take corrective actions such as suspending or closing user accounts, blocking access, and withholding unpaid rewards if a user fails to comply with these terms.


 
While Soulfy does not guarantee to monitor all user actions and content, we reserve certain rights to do so:
 
– For operational, safety and legal compliance purposes.
 
– To ensure adherence to the terms of use and community guidelines.
 
– We may remove or disable any content, profiles or parts of the service at our discretion if deemed objectionable or violating.
 
– Soulfy has the authority to investigate potential violations or harmful behaviour on the platform.
 
– As necessary, we will cooperate fully with lawful requests from law enforcement, and may provide user data if needed to prevent risk of harm.
 
Content ownership
 
When sharing any content on Soulfy, you represent that you have obtained permission from anyone identifiable, own or have proper licence for copyrighted material, and grant Soulfy a perpetual licence to use the content for operating the service, marketing, and internal/external research in anonymous and aggregated form. You also represent that your content and Soulfy’s use of it will not infringe upon others’ intellectual property, publicity or privacy rights or violate laws, and you take full responsibility should any legal issues arise related to content you submit to protect both your interests and Soulfy’s terms of use. 

 
DMCA Policy for Soulfy
 
In accordance with the Digital Millennium Copyright Act (DMCA), Soulfy responds promptly to valid notices of alleged copyright infringement. 
 
If you believe content on Soulfy infringes your copyright, send a written notice to [email protected] including: (1) identification of work and infringed rights; (2) description of infringement; (3) contact details; (4) statement of good faith belief; (5) declaration of accuracy. 
 
Consequences of Infringement
 
Repeat infringers’ Soulfy accounts will be terminated. We may disclose username and personal details to rights owners taking legal action. Termination is subject to appeal via [email protected] within 30 days.
 
You may delete your User Content via the functionality of the Services, but understand it may persist anonymized in backups for a standard retention window to allow for record-keeping, restoration or other internal uses before being permanently destroyed.
 
While Soulfy asserts no ownership of user-generated content, members should be aware that the company retains exclusive rights over all aspects of the Soulfy platform and service itself, including any associated intellectual property. The Soulfy experience is legally protected by copyright, and other laws, and users are granted permission to utilise the service as outlined in the Terms of Use. However, modifying or removing proprietary notices from Soulfy’s owned components without consent is prohibited, and the company reserves the right to fully protect its virtual innovations through appropriate legal routes. This balanced approach allows users to connect freely while also maintaining Soulfy’s custodianship over the technical infrastructure enabling those connections.
 
Soulfy allows members to engage with platform features and content for their personal use, provided they adhere to the Terms of Service. Specifically, each user is granted a limited, non-transferable licence to access, view and interact with the Soulfy experience solely through standard interaction with the authorised services. This access is only for individual, non-commercial purposes consistent with the intention of fostering meaningful connections. Compliance with the Terms of Service is necessary to maintain these usage privileges over Soulfy’s proprietary offerings.

 

Prohibition of Third-Party App Promotion

 

Promotion and persuasion of other users to utilize or engage with third-party applications or services are strictly prohibited. Our platform is designed to provide a secure and seamless experience within our own ecosystem, and we strive to maintain the integrity and safety of our users. Any attempts to encourage or convince other users to use external applications or services may result in account suspension or termination. 

 
Violation of terms
 
Soulfy reserves the right to suspend or terminate a user’s account, block access, and withhold unpaid rewards if the user violates the Terms of Service. Soulfy maintains sole discretion in determining if termination is warranted based on the nature and severity of the breach. Users are expected to abide by the community guidelines and applicable laws when participating on the platform. Non-compliance may result in restrictions or loss of account privileges at Soulfy’s judgement.
 
On rare occasions, technical abnormalities or suspicious activity may trigger automated protection measures for the safety and security of our users. 
 
We take any decision to suspend an account seriously. If you believe your suspension was made in error, you may appeal by contacting us through our support form. 
 
Inactive accounts
 
Accounts must maintain monthly activity or be marked “inactive”. Inactive accounts are invisible on the platform. Any rewards from that month will also be removed. All revenue/earnings calculations will be unified based on UTC time zone (i.e. +0:00).
 
This policy ensures engaged participation and optimised systems by not holding rewards for abandoned accounts indefinitely. Go online before the month ends to maintain active status. One activity within the next month will reactivate the profile going forward. Contact us if special consideration is needed for inactivity.
 
If you wish to permanently close your Soulfy account, you can initiate the deletion process through your account settings in the application.
 
Monetization terms
 
By actively contributing high-quality content to Soulfy and engaging with other members, you have the potential to earn money from our system.
 
Content Monetization
 
You can choose to monetize certain contributions by marking them as “Locked”. Other members must spend gems to access Locked content. As the creator, you will receive a portion of the reward credits earned from viewers.
 
Content Guidelines
 
All content shared on Soulfy must comply with our Community Guidelines. Soulfy reserves the right to disable monetization of any non-compliant content, withhold or deduct earnings for individual users found to be in violation of our terms, without prior notice. This decision over eligibility and amounts for earnings is at our sole discretion based on factors like the nature of shared content, engagement, and policy compliance to ensure Soulfy remains a safe and inclusive platform for all.
 
Earnings Schedule
 
Reward credits earned from users spending and account engagement will be settled between the first day and the last day of each natural month. Profits will be deposited into your linked Paypal account on the 26th or after of the following month. Due to the payment schedules of platforms, earnings deposits are subject to their payment cycles. All payouts from our platform depend on when Apple/Google/each platform releases earnings, as we will payout at the same time. There may sometimes be delays, for example on non-working days, holidays, or delays from banks. Since our payout schedule is based on when we receive funds from the platforms, there could be potential delays in payouts due to non-working schedules of the platforms or financial institutions. We aim to process payouts as soon as we receive the earnings, but there may be occasions where payout is delayed for reasons mentioned above. We appreciate your understanding of this process. Payout amounts will be rounded down to the nearest 0.01 of the payout currency. If the payout amount is less than the minimum payout amount or processing fees required by the payout platform, no payout will be made.
 
Tiers and Thresholds
 
You must reach certain reward credit thresholds to enter tiers to receive respective money rewards. Your tier is calculated based on total credits earned during the settlement date of each month. Tiers are refreshed and reward credits reset to zero every month.
 
No Guarantee
 
While the system aims to reward engagement, actual earnings vary based on multiple factors outside our control. Soulfy does not guarantee any minimum payments.
 
Adjustments
 
Soulfy may change earning rates, remove invalid reward credits, or alter the system at any time to improve sustainability. Updates will be announced.
 
Disputes
 
We may withhold earnings related to disputed or refunded transactions until the issue is resolved. Our decision is final.

 

Distribution and Use of Funds by Users

 

Soulfy shall distribute any funds owed to users according to its user reward and incentive programs. However, once funds have been transferred to users, the subsequent use and management of those funds becomes the sole responsibility of each individual user. Users agree to adhere to all applicable payment processing rules regarding receipt and use of any funds received from Soulfy. By receiving payment, users acknowledge that Soulfy assumes no responsibility or liability for how users subsequently manage or utilize those funds. Users receive and utilize any funds at their own risk without recourse against Soulfy.

 
Laws
 
You are responsible for understanding and complying with applicable tax laws and regulations based on your country of residence and any laws that may apply depending on your earnings and activity on the platform.
 
Premium Content and Features
 
Certain additional or exclusive content, features, and capabilities may be available through a premium subscription.
 
Subscription Plans and Pricing
 
Premium subscriptions are offered on a monthly basis. Current pricing tiers and their included benefits will be displayed on the app. 
 
Payment
 
Your selected payment method will be charged on a recurring monthly basis for the subscription. Soulfy uses secure third-party payment processors.
 
Automatic Renewal
 
Unless cancelled, your subscription will renew monthly automatically and you authorise us to charge the applicable fee to your payment method on file.
 
Cancellation & Refunds
 
You can cancel your subscription at any time in your account settings. Cancellations are effective at the end of the current billing period. No refunds are given for partial periods.

 

Purchases made on Soulfy are non-refundable. However, there might be exceptions based on specific circumstances or applicable laws that would . If you subscribed to Soulfy using your Apple ID, refund requests are handled by Apple. To request a refund, you can visit iTunes, click on your Apple ID, select “Purchase history,” locate the transaction, and click on “Report Problem.” Alternatively, you can submit a refund request through the Apple Support website at https://getsupport.apple.com.

 

If you subscribed to Soulfy using your Google Play Store account, please follow the refund process outlined on the official Google Play support website (https://support.google.com/googleplay/workflow/9813244?hl=en). They will provide the necessary instructions and assistance for refund requests related to your Soulfy subscription.

 
Subscription Interruption
 
If payment fails or your account is past due, access to premium benefits may be interrupted until payment is processed successfully.
 
Terms Change
 
Pricing, features, and terms are subject to change with notice. Your continued use of premium benefits after such changes indicates acceptance.
 
Content Access
 
We reserve the right to alter or remove access to any content at any time. Subscription may not yield a specific inventory or quantity of content/features.
 
Licence to use our Services
 
Soulfy’s intellectual property is protected globally. Users are granted a limited licence to access the platform as intended by the Terms. This allows standard personal use of Soulfy software/services.
The licence does not allow commercial exploitation of Soulfy’s brand or unauthorised copying. It terminates upon account closure or Terms violation. Soulfy owns all legal intellectual assets. Non-compliance may face penalties.
 
Limitation of Liability
 
By using our services, you agree Soulfy’s liability is limited to the maximum extent permitted by law. This applies to Soulfy, its affiliates, officers, employees, agents, partners and licensors.
 
Applicable law and jurisdiction
 
For any legal matters, you and Soulfy consent to the exclusive jurisdiction of Hong Kong courts and Hong Kong law. All claims will be subject to these courts and this governing law, unless prohibited by your own region’s laws. By using our services, you submit to the jurisdiction of Hong Kong courts to litigate any disputes. Both parties waive objections to this jurisdiction and venue.
 
Feedbacks
 
Soulfy values input from members to enhance the community experience over time. Users may provide Feedback to Soulfy by email or through in-app and/or website features. By submitting Feedback, a user grants Soulfy a broad, irrevocable licence to use, modify, sublicense and otherwise benefit from such Feedback without compensation or attribution. This ensures Soulfy can continuously iterate and foster the best possible services, while respecting members’ intellectual property rights in their original profile details and shared content. Continuous learning together is how Soulfy seeks to empower ever more caring connections.

SoulfyCoin

SoulfyCoin (referred to as “Coin” hereafter) is the native cryptocurrency of the Soulfy platform.

To be eligible for receiving SoulfyCoins, a user must be 18 years or older, have a registered account on the Soulfy platform, and have agreed to both the Soulfy Terms of Service and Privacy Policy. They must also reside in a jurisdiction where the use of cryptocurrency is not banned or prohibited by law.

Distribution of SoulfyCoins is subject to the same eligibility terms as Soulfy’s monetary reward program. To receive coins each month, users must actively participate on the platform with other members of the Soulfy community. The distribution amount will be calculated based on a user’s level of engagement and participation on the platform during the preceding month. Their monthly coin distribution amount will be calculated based on the same metrics and methodology used to determine money payouts for the reward program. Soulfy reserves the right to adjust this calculation methodology and alter the engagement requirements for receiving coins at its discretion.

SoulfyCoins will be deposited into user’s wallets on the Soulfy app. Soulfy assumes no responsibility for any coins stored, transferred or managed outside of the official app wallet. It is the user’s responsibility to keep their account login credentials private and secure to avoid unauthorized access by other parties that could compromise coins in their wallet. While Soulfy utilizes industry standard practices to secure the technical infrastructure handling coins, it cannot guarantee absolute protection from all potential cyber threats.

Any SoulfyCoins that go unclaimed or undistributed due to a period of 60 or more days of account inactivity will automatically expire. Expired coins will be permanently removed from the user’s wallet and balance. It is the responsibility of each user to login to their account at minimum once every 60 days in order to maintain their coin eligibility and prevent expiration.

In the future, when withdrawal functionality is enabled, it may become possible for users to transfer their accumulated SoulfyCoins out of the app wallet and into personal cryptocurrency wallets controlled by the user. Withdrawals will be subject to a small transaction fee paid in SoulfyCoins to cover nominal blockchain processing costs. Withdrawn coins can only be sent to verified cryptocurrency addresses and not directly converted into fiat currency. Soulfy is not liable for any transactions, transfers or activities involving coins outside of the platform.

Users should be aware that SoulfyCoins do not have any guaranteed monetary value currently and are not a financial security, investment or official currency. The potential value of Soulfy depends on external market value and may vary over time. No promises are made regarding the fluctuation of the value of SoulfyCoin over time.

It is the user’s responsibility to understand and comply with all laws regarding cryptocurrency ownership and transfers within their local jurisdiction. Soulfy cannot assist or advise on any unlawful or unauthorized uses of cryptocurrency.

Soulfy maintains full rights to amend these terms and conditions or discontinue the SoulfyCoin program entirely upon providing notice to users through an in-app message notification and website announcement.

At Soulfy, our goal is to spark new connections and insights. We believe that meaningful relationships are built on transparency, vulnerability and kindness. That’s why we’ve created a social environment where users can feel comfortable sharing snippets of their everyday lives – on their own terms and in their own voices. By bringing people together through spontaneous acts of openness, our hope is that users will find surprises, support and joy through discovering one another authentically. At its core, Soulfy aims to be a place of belonging – where individuals can express their true selves without fear of judgement, and interactions are defined by empathy, respect and understanding. These Community Guidelines aim to support that goal.

 

They establish principles of safety, respect and belonging for all members engaging with one another both on the platform and beyond. Following these guidelines ensures Soulfy can continue providing a space for people to openly learn about others in a safe and meaningful way.

 

Please abide by your responsibilities as a user, engage respectfully in discussions, show care for others, and respect different perspectives. Only in this type of environment can we learn from one another and build understanding. If Community Standards are not followed, we may need to temporarily restrict or deactivate your account.

 

Ultimately, we hope these rules help foster fun and thoughtful exchanges that respect each person’s experience. Open-hearted connections are what Soulfy strives to cultivate.

Bullying, Harassment and Abuse
Do not share content that bullies, harasses, or abuses other users or non-users.

 

Child Exploitation and Endangerment
Any content involving child exploitation or endangerment is strictly prohibited.

 

Hateful and Discriminatory Content
Do not share content that promotes hate, discrimination or intolerance towards individuals or groups.

 

Illegal or Dangerous Acts
Do not share content that encourages or enables illegal, dangerous or harmful activities.

 

Intellectual Property
Do not share content that infringes on copyrights, trademarks or other intellectual properties.

 

Non-consensual Nudity or Imagery
Do not share explicit or private content without proper consent.

 

Privacy and Security
Do not share other users’ private information like addresses or contact details without permission.

 

Self-harm and Suicidal Content
Do not share content that promotes or glorifies self-harm, suicide or life-threatening acts.

 

Threatening or Dangerous Speech
Do not share violent, threatening, or dangerous content targeting individuals or groups.

Extended rules as follows:

 

Respect Boundaries

Comfort levels regarding intimate topics vary between individuals. As such, sexually explicit or soliciting content is prohibited from public profiles. However, such discussions are permissible within private conversations given affirmative consent from all parties. 

 

Exercise Caution with Private Details

Users should refrain from publicly displaying private information such as phone numbers, email addresses, financial account numbers or passwords, as this could enable malicious actors. Requesting such sensitive data from others is also prohibited. 

 

Prohibit Violent Content  

Promoting or glorifying violence, harm against people or animals, weapons use, or advocacy of self-injury compromises our values of positivity. Content containing such negative themes will be removed.

 

Prioritise Safety

If a risk of imminent danger is perceived, we may intervene by providing crisis resources support.

 

Discourage Commercial Activity  

This platform aims to foster personal connections, not business promotions or sales. Advertisements, solicitations, escort services or compensated relationships are therefore prohibited.

 

Require Authentic Representation

Accounts should accurately reflect the identity of their owner, rather than impersonating others disingenuously. 

 

Demand Respectful Exchange

All interaction must be conducted respectfully and without harassment, threats, bullying or hate targeting attributes such as race, gender, beliefs or physical characteristics. 

 

Proscribe Harmful Conduct   

Behaviours inflicting or advocating for physical or digital harm against members will be strictly sanctioned on and off the site. 

 

Enforce Age Requirements

Users must be at least 18 years of age. Content featuring any unaccompanied or unclothes minors is prohibited. For age violations please report to us through [email protected].

 

Outlaw Illicit Behaviour

No illegal activities, merchandise, advice or human/drug trafficking may be facilitated through the platform.

 

Require Unique Accounts  

Each member must utilise a singular, personal account rather than sharing access with multiple individuals.

 

Protect Original Content  

Members should only post materials to which they own the rights, not misappropriating copyrighted or private works without permission.

 

Preserve Integrity  

Dishonest practices like spreading misinformation, abusive behaviours, spamming, compromised accounts or manipulation compromise the community standards and will not be tolerated.

 

Maintain Active Membership

Prolonged periods of inactivity may result in account inactivation to optimise the user experience. Please engage periodically to remain visible.

 

Reporting

 

Soulfy prioritises community well-being and holds members to high standards of conduct. Minor guideline issues may receive warnings, but consistent or severe breaches could affect an account. We investigate reported accounts as needed and reserve the right to terminate membership without refund if one misuses the service or violates our values – even if the problem originates externally but involves other users. With care and responsibility on all parts, our goal is for Soulfy to be a caring sanctuary for connection.

 

You can report violations of the Community Guidelines using the in-app reporting tools or via our online web form. The moderation team may need your username, name and email to contact you about a report. This information will be kept confidential. The team will review all reports and determine if a breach of guidelines occurred.

 

When reporting content from a conversation, take screenshots of any concerning content before it can be removed. When applicable, refunds will be given according to the situation.

 

Accounts or posts found to violate rules may be temporarily or permanently restricted at our discretion.

 

We reserve the right to monitor the app and activity for compliance purposes. Our decisions on violations are final.

 

If you believe an enforcement action against your account was made in error, you can submit an appeal via the contact form on the app or website.

 

Self-spam Prevention Mechanism

 

To promote meaningful conversations and fair platform usage, Soulfy has implemented a mechanism to temporarily suspend rewards if a chat room exceeds a certain daily message limit from a single user.

This is to discourage attempts to artificially inflate messaging levels solely for earning rewards. While typical interactions will not be affected, this ensures the platform’s incentives align with our goal of fostering quality discussions among our community.

This Privacy Statement forms part of the Soulfy Terms of Service and applies to all users of the Soulfy platform. The Terms of Service, community guidelines, and Privacy Policy, collectively make up the “Soulfy User Agreement” that governs a user’s access to and use of Soulfy. We do not collect any personal information about you unless you voluntarily provide it to us through our website or mobile app. Any personal information collected will be used only for the purpose of providing the Soulfy services and features to you.

At Soulfy, the protection and security of our users’ personal information is our top priority. We have implemented robust technical and organisational security measures designed to protect data from unauthorised access, use, disclosure, alteration or destruction.

Your display name is how others identify you, so using your real name publicly displays that information to all. For monetisation purposes, we collect additional details like address and banking info for payouts and identity verification including tax IDs as required by law.

Member Account Cancellation

 

If you wish to close your Soulfy member account, please log in to your Soulfy profile and select “Delete Account” from the Settings menu.

 

Once your cancellation request is processed:

– Your profile and all personal data will be permanently deleted from our systems within 30 days as required by law.

– Any pending earnings or balances will be paid out according to our payment schedules.

– Your activities and conversations on Soulfy will no longer be accessible.

– You will be logged out and unable to access Soulfy going forward.
